Terms of Service

01.Who We Are, and What This Document Is

The operator of NADI VPN (the “Service”) is Nadicorp Ltd (England & Wales, UK, nadicorp.net, contact: [email protected]).

In this document, “we”, “us” and “our” mean the operator, and “you” means the person using the Service. These Terms, together with the Privacy Policy, Acceptable Use Policy, Abuse Reporting Policy, Law Enforcement and Legal Requests Policy, P2P and Copyright Policy, and Pass, Payment and Refund Policy, form the agreement between you and us for your use of the Service. If any part of those policies conflicts with these Terms, the more specific policy applies to its own subject.

The Service is a WireGuard-only virtual private network service. We do not provide a proprietary client application. You receive a standard WireGuard configuration file (.conf) and a high-contrast QR code for use in the official WireGuard application. The Service operates high-performance relays in Kerkrade, Netherlands, and Nuremberg, Germany.

02.Acceptance and Eligibility

By creating an account, buying a pass, or using the Service, you accept these Terms. If you do not accept them, do not use the Service. You must be legally able to enter into a binding agreement in your jurisdiction, and you must use the Service only in accordance with the laws that apply to you and to the relay locations.

03.The Service and Passes

Passes are disposable and are sold for 1, 7, 15 or 30 days. There are no recurring subscriptions and no automatic renewal. A pass gives one concurrent active connection. The price, duration and payment options shown at checkout apply to that pass. After payment confirmation, activation is automated; it is not instant in the sense of being immediate regardless of blockchain confirmation, and a failed or pending payment does not create a usable pass.

You are responsible for keeping your account email access, your configuration file and your private key secure. Your private key is generated client-side in your browser and is never sent to us. If you share your configuration or your account, you remain responsible for use made through it.

We may change, suspend or withdraw a relay, a feature, or the Service as a whole for operational, security or legal reasons. Where reasonably possible, we will give notice in advance, but we are not required to keep any particular relay available for the full length of a pass if continued operation would be unlawful or unsafe.

04.Your Responsibility for Your Own Use

You are responsible for everything done through your account and your WireGuard public key, whether or not you did it personally. You must use the Service lawfully and in accordance with the Acceptable Use Policy. You must not use the Service to commit, facilitate or conceal a criminal offence, to infringe the rights of others, or to disrupt the Service, its relays, or any third-party network.

We do not endorse, direct, monitor or control what you do through the Service. We do not inspect the content of your traffic. Your responsibility for your use is not transferred to us by the fact that traffic passes through a shared relay, and nothing in these Terms is a promise that any authority will treat the matter in any particular way. Liability for unlawful use is governed by applicable law, not by this paragraph alone.

05.Suspension, Warning, Appeal and Termination

We may warn you, suspend your pass, block a public key, or terminate your account where we have reasonable grounds to believe that:

  • You have breached these Terms or the Acceptable Use Policy;
  • Your use is causing, or is likely to cause, harm, disruption or unlawful activity;
  • We are required to act by a validated lawful order, or by a host or infrastructure provider acting on a credible abuse report; or
  • Continued operation of your account would put the Service, its relays or third parties at material risk.

Where it is reasonably possible and lawful to do so, we will warn you first and give you a reasonable opportunity to stop the relevant use. Warning is not required where the use involves child sexual abuse material (CSAM), an active network attack, or an imminent risk of serious harm, or where warning would be unlawful or would defeat the purpose of the action.

If your account or pass is suspended or terminated, you may appeal by contacting us at [email protected], stating your account email and the reason you believe the action was wrong. We will review the appeal and tell you the outcome. An appeal does not suspend the action while it is being reviewed, unless we decide otherwise.

On termination, your pass ends and any unused time is dealt with under the Pass, Payment and Refund Policy. Termination does not remove your responsibility for use that occurred before termination, and it does not prevent us from acting on a validated lawful order or from reporting suspected criminal activity as described in the Law Enforcement and Legal Requests Policy.

06.Payments

Payment is by cryptocurrency only, as described in the Pass, Payment and Refund Policy. Cryptocurrency transactions are irreversible once confirmed. Except where the Pass, Payment and Refund Policy provides otherwise, payments are final and non-refundable after confirmation.

07.What We Do Not Promise

The Service is provided as described on our technical documentation. We do not promise that the Service will be uninterrupted, error-free, or available at any particular speed. We do not promise that the Service will unblock any streaming service, bypass any third-party filtering or censorship system, or provide locations beyond Kerkrade and Nuremberg. We do not promise absolute anonymity. A VPN encrypts network traffic; it does not make you anonymous, and it does not protect you from a service you log into, from a weak password, or from malware on your own device.

08.Limitation of Liability

To the maximum extent permitted by applicable law, our total liability to you for any claim arising from your use of the Service is limited to the amount you paid for your current pass. Nothing in this section limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud. You remain liable for loss or damage caused by your unlawful use of the Service.

09.Changes to These Terms

We may change these Terms where reasonably necessary, for example to reflect a change in the law, in the Service, or in our operating costs. Material changes will be published on the legal pages with a new last-updated date. Continued use of the Service after a material change takes effect means you accept the changed Terms. If you do not accept a change, you should stop using the Service before it takes effect.

10.Governing Law and Dispute Resolution

These Terms, their subject matter, and their formation (and any non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Netherlands and the Federal Republic of Germany, matching the operational jurisdictions of the underlying relay infrastructure in Kerkrade and Nuremberg.

Any dispute, controversy, or claim arising out of or in connection with these Terms or the breach, termination, or invalidity thereof shall be submitted to the competent courts of the relevant relay jurisdiction, without prejudice to any mandatory consumer protection rights that apply under the laws of your country of residence.

11.Contact Information
