P2P & Copyright Policy
01.Legitimate Peer-to-Peer Use Is Permitted
Legitimate peer-to-peer (P2P) and BitTorrent traffic is fully permitted on NADI VPN, subject to the Acceptable Use Policy and to this policy. Permitted use includes the decentralized transmission of open-source software, operating system images, public datasets, creative commons media, and blockchain ledger distribution.
Permitted use does not include the unlawful distribution of copyrighted material, the distribution of child sexual abuse material (CSAM), or any other unlawful activity. A pass allows one concurrent active connection, and fair use of shared relay network bandwidth applies.
02.EU Notice-and-Action Framework
Because NADI VPN relays are located in Kerkrade, Netherlands, and Nuremberg, Germany, copyright and abuse notices are handled under European Union notice-and-action frameworks (Directive 2000/31/EC and the EU Digital Services Act), rather than US-centric DMCA safe harbor procedures.
Rights holders, designated copyright agents, or network operators must send formal notices to our designated abuse desk at [email protected].
03.What a Copyright Notice Must Contain
To enable proper legal assessment, a copyright notice must be in writing and contain:
- Specific identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, including the specific relay IP address, timestamp, port number, and time zone.
- Sufficient evidence supporting the claim beyond an automated, uncorroborated IP-only scraping log.
- The notifier’s legal name, representation authority, and physical/email contact address.
- A formal statement that the information in the notification is accurate and that the notifier is authorized to act on behalf of the copyright owner.
04.Action on Valid Notices vs. Uncorroborated IP-Only Notices
Upon receiving a copyright notice that is specific, credible, and supported by corroborated evidence beyond a shared relay IP address alone, we will assess it and take proportionate action against an identifiable account under the suspension and termination procedure in the Terms of Service.
05.Child Sexual Abuse Material (CSAM) — Zero Tolerance
Child sexual abuse material is not a copyright issue and is treated as an urgent criminal matter under our zero-tolerance policy. Any confirmed or credible report of CSAM will trigger immediate account termination, public key revocation, and reporting to relevant EU/international authorities under our Law Enforcement Policy. CSAM reports must not be sent as copyright notices.
06.Repeated Notices and Notice Process Abuse
Notices that are repeatedly unsubstantiated, speculative, or sent in bad faith to harvest user data without a lawful court order will be logged as abusive, and we may decline to process further notices from that source without independent judicial evidence. Users who believe an action taken against their account was erroneous may file an appeal under the Terms of Service.
